Terms of Bidding and Sale
These Terms of Bidding and Sale apply to all machinery auctions operated by Almacenes Revilla.
1. Auctions
Lots are sold through timed online auctions. Unless otherwise stated, lots are sold to the highest bidder at the auction closing time.
Some lots may be subject to a reserve price. Where a reserve applies, the lot will be sold only if the reserve price is reached.
All bids are binding and cannot be withdrawn once placed.
2. Condition of Goods
All lots are sold on an “as is, where is” basis. Buyers are responsible for reviewing the lot description, photos and inspection information before bidding.
Inspection reports are provided for guidance only. If the auction schedule allows sufficient time, buyers are encouraged to inspect the machinery in person by appointment before placing a bid.
3. Fees and VAT
A transaction fee is added to the winning bid:
- Up to €5,000: 5%
- €5,000–€25,000: 3%
- Above €25,000: 1%
There are no fixed minimum fees. Applicable VAT will be added where required by law.
4. Payment
After a successful bid, Almacenes Revilla will send the buyer a contract and payment document.
Full payment must be made by bank transfer within 48 hours of receiving these documents. Cash payments are not accepted.
If payment is overdue, Almacenes Revilla may charge interest and recover reasonable costs related to the late payment.
5. Collection and Delivery
Machinery may be collected from Almacenes Revilla only after full payment has been received and by prior appointment.
Alternatively, machinery may be delivered to the buyer’s location. Delivery arrangements and transport costs will be agreed with the buyer after the sale.
6. Unpaid Lots
If a lot is not paid within the 48-hour payment period, Almacenes Revilla may cancel the sale, relist the lot and exclude the defaulting bidder from future auctions.
7. Seller Bidding
Sellers and their representatives are not permitted to bid on their own lots.
8. Governing Law
These Terms are governed by the laws of Spain. Any dispute arising from an auction or sale will be subject to the competent courts in Spain.
